PUWER

Provision and Use of Work Equipment Regulations 1998 (PUWER) places crucial responsibilities on individuals, companies, and organizations involved in the ownership, operation, or control of work equipment. It also extends obligations to businesses and entities whose employees engage with work equipment, whether it is owned by them or not.

Work equipment encompasses a vast range of machinery, appliances, apparatus, tools, and installations intended for use in the workplace, regardless of exclusivity. This definition also encompasses equipment that employees provide for their personal use at work. The scope of work equipment is extensive, and the definition of its use is interpreted broadly, encompassing activities such as starting, stopping, programming, setting, transporting, repairing, modifying, maintaining, servicing, or cleaning, as per the Provision and Use of Work Equipment Regulations 1998.

In the United Kingdom, strict legal requirements mandate compliance with PUWER. Non-compliance can lead to severe consequences, including:

  • Financial Penalties: Fines can be imposed for failing to adhere to PUWER regulations, resulting in significant financial burdens for individuals and organizations.

  • Criminal Charges: Serious breaches of PUWER may lead to criminal charges, potentially resulting in legal proceedings and reputational damage.
